Welcome & Acceptance of Terms

Welcome to the Bosnia Guide platform (hereinafter: the Platform). By using any part of the Platform, you automatically accept all terms of use. Users are required to read the terms of use regularly, and it is assumed that by continuously using the Platform, they are familiar with the terms at all times and have fully understood and accepted them. No part of the Platform may be used for illegal purposes or to promote them.

About the Bosnia Guide Platform

The Bosnia Guide Platform publishes content in good faith. All content is used at your own risk, and the Platform cannot be held responsible for any damage resulting from the use of the content. Published content is available to all visitors. The Platform is not specifically directed at children under 16, though access is not restricted.

Copyright & Intellectual Property

• Bosnia Guide holds copyright on all its own content (text, visual and audio materials, databases, programming code, and other materials). Unauthorized use of any part of the Platform without the copyright owner's permission constitutes copyright infringement and is subject to legal liability.
• Content may not be reproduced, distributed, or used for commercial purposes without the Platform's explicit consent or in a way that could cause harm to the Platform or third parties.
• Automated access to the Platform — including but not limited to web scraping, crawling, data mining, or any form of automated data extraction — is strictly prohibited without prior written consent from Bosnia Guide.
• All data, photographs, text, design elements, database structures, and compilations published on the Platform are protected by copyright and database rights. Any unauthorised reproduction, distribution, or use of Platform content is prohibited and may result in legal action.
• If you believe that any content infringes your rights, you may request the publication of a response or correction. The case will be reviewed, and disputed content removed if the claim is found to be valid.

Intellectual Property Takedown Procedure

• If you believe that any content on the Platform infringes your intellectual property rights, you may submit a takedown request to hello@bosnia.guide.
• Your request must include: identification of the copyrighted work, identification of the infringing content on the Platform (with URL if possible), your contact information, a statement that you have a good-faith belief the use is unauthorised, and a statement that the information is accurate.
• We will review all takedown requests and, if the claim is valid, remove the infringing content within a reasonable timeframe.

Published Content

Content is informational and tourism-oriented, aimed at promoting tourism across Bosnia and Herzegovina, including accommodation, hospitality, and tourist facilities. The Platform is not responsible for any damage that may result from using third-party services presented on the site.

Platform Users

Users are considered all those who use the Platform in any way, whether offering their own services (e.g., hospitality providers or accommodation owners) or browsing the tourist offer. By using the site, you confirm that you are aware of and agree with these Terms of Use.

Platform Use & Contributor Accounts

• The Platform is primarily an informational tourism resource. Most visitors use it without registering.
• The Platform also allows certain users to create an account in order to contribute content (e.g., to propose new locations, upload images, submit 360° panoramic imagery, video references, events, or tour information). These users are referred to as 'contributors'.
• All information published on the Platform is provided for informational purposes only. We do not warrant the accuracy, reliability, or availability of third-party services or content presented via the Platform.

Promotion of Restaurants, Accommodation & Services

• The Bosnia Guide Platform publishes information about restaurants, accommodation, tourist activities, and other offers solely for promotional and informational purposes. The Platform does not provide, sell, or mediate the provision of these services.
• All data regarding restaurants, apartments, activities, etc., are available to promote the local offer, and end users must contact the providers directly for all information, reservations, and arrangements.
• The Platform does not guarantee the accuracy, availability, quality, safety, or legality of any service presented on the site and expressly disclaims responsibility for any damage, misunderstandings, or losses resulting from the use of third-party services.

Promotion of Local Producers & Shops

• The Bosnia Guide Platform allows the promotion of local shops, individual producers, and products in the organic and bio sectors. This promotion is solely informational and promotional, and the Platform is not considered a seller or intermediary in transactions between users and advertisers.
• Each advertiser, whether an individual or legal entity, is fully responsible for the accuracy and legality of all information published, including product descriptions, photos, prices, origin, and any certificates. The Bosnia Guide Platform does not guarantee the quality, safety, origin, or legality of products presented through these advertisements.
• Users must independently assess third-party offers and contact advertisers directly for all information, orders, and potential complaints. The Platform expressly disclaims responsibility for any damage, misunderstandings, or disputes that may arise from the relationship between users and third parties presented on the site.
• The Platform reserves the right to remove content that is inaccurate, illegal, misleading, offensive, or otherwise inconsistent with the terms of use and applicable laws.

Sports & Adventure Activities Disclaimer

• The Bosnia Guide Platform may contain information about sports, recreational, and adventure activities (such as rafting, zipline, hiking, cycling, and others). These activities may carry significant risks and present potential hazards to health and safety.
• The Platform does not organize or mediate the organization of any activity. The content is purely informational and serves to promote the region's tourist offer.
• Use of information and participation in these activities is entirely at the user's own risk. The Platform is not responsible for any injuries, material damage, or other consequences that may result from participation in the activities mentioned or promoted on the site.
• Users are advised to consult qualified instructors and licensed organizers before participating and to familiarize themselves with conditions, equipment, and safety procedures.

Tours, Events & Third-Party Activities

• The Platform may display information about tours, events, and third-party activities provided by independent third parties (collectively, 'Third-Party Offerings'). This information is published for promotional and informational purposes only.
• The Platform does not organize, operate, sell, schedule, broker, mediate, take payment for, refund, insure, or guarantee any Third-Party Offering. The Platform receives no commission, booking fee, ticket fee, or transaction fee from any Third-Party Offering.
• All contact, booking, scheduling, payment, attendance, refunds, complaints, and delivery happen directly between the visitor and the third-party provider, outside the Platform.
• The third-party provider is solely responsible for: the accuracy of every detail published (price, duration, dates, times, location, included items, language, transportation, safety, equipment, cancellation policy, age restrictions, capacity, and similar); the delivery of the experience as described; the safety, insurance, qualifications, and licences of staff; compliance with all applicable laws; and the handling of all complaints, refunds, and disputes.
• Visitors use Third-Party Offerings entirely at their own risk. The Platform is not liable for any injury, illness, loss, damage, delay, cancellation, misrepresentation, fraud, or dispute arising from a Third-Party Offering.
• Visitors are advised to verify the provider's credentials, insurance, and safety procedures directly with the provider before booking or participating.

AI-Generated Content

• Some content on this website, including but not limited to text, images, and illustrations, may be generated using artificial intelligence tools (e.g., ChatGPT, DALL·E, or other AI services). While we strive for accuracy and relevance, AI-generated material may contain errors or inaccuracies and is used solely for informational and illustrative purposes. Visitors use such content at their own risk.
• AI-generated itineraries, recommendations, and responses are suggestions only and do not constitute professional advice, official tourism guidance, or any form of guarantee.
• The Platform expressly disclaims all liability for decisions made based on AI-generated content, including but not limited to travel bookings, route choices, accommodation selections, and activity participation.
• Users are solely responsible for independently verifying all information provided by the AI assistant before acting on it.

Communication via AI Assistant

• The Platform allows users to submit inquiries through an integrated AI assistant, which provides automatically generated responses based on available data and AI models.
• Responses provided by the AI assistant are for informational purposes only and should not be considered advice or official information from the Platform.
• The Platform does not guarantee the accuracy, completeness, or applicability of responses provided by the AI assistant and expressly disclaims responsibility for any damage that may result from relying on such information.
• To access the AI assistant functionality, users must enter a valid email address. This email address is used solely for responding to submitted inquiries and technical notifications. It is not used for marketing purposes and is not shared with third parties.
• By using the AI trip planner, you acknowledge and agree that your input data (travel dates, group size, interests, preferences, and any free-text notes) is transmitted to OpenAI, LLC (United States) for processing. See our Privacy Policy for full details.
• Data may be transferred outside the European Economic Area (EEA) in accordance with applicable data protection laws. See our Privacy Policy for details on safeguards applied to international transfers.
• You should not submit any sensitive or special category data (as defined in Art. 9 GDPR) through the AI assistant, including but not limited to health information, religious beliefs, political opinions, ethnic origin, sexual orientation, or biometric data.

Submitting Content to the Platform

• The Platform allows users to submit content, including but not limited to location proposals, descriptions, photographs, 360° panoramic imagery, video references, events, tour information, and other text or media (collectively, 'Submitted Content'). Submission may be made through the public location request form or through a contributor account.
• By submitting any content, you confirm that all provided information is accurate, complete, and does not infringe the rights of any third party.
• By uploading images, panoramic imagery, video references, or other media, you confirm that you are the owner or authorised rights holder of that media and that its publication does not violate any copyright, trademark, privacy, publicity, moral, database, or other applicable right; you also confirm that every identifiable person depicted has consented to publication.
• You grant Bosnia Guide a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable licence (for as long as the Platform retains the Submitted Content) to use, store, display, publish, modify, crop, translate, distribute, and promote the Submitted Content in connection with the operation and promotion of the Platform. This licence survives any deactivation of your account.
• Personal data collected in connection with a submission (first name, last name, company or organisation name, phone number, email address) is used solely for communication related to the submission — to verify, review, or follow up on the content. This data is not publicly displayed on the Platform.
• The Platform reserves the right to review, edit, reject, or remove any Submitted Content at any time and without prior notice, including content that is inaccurate, misleading, unlawful, offensive, or inconsistent with these Terms of Use.
• Public location request submissions are active for a limited period of 30 days from the date of publication, after which they may be renewed or removed. The Platform may contact the submitter via the provided email address to offer renewal before the listing expires. Renewal requires active agreement from the submitter. If no renewal is agreed upon, the listing becomes inactive and may be removed.
• The submitter is solely responsible for the accuracy and legality of all Submitted Content, including any images or other media uploaded.

User-Generated Content & Liability

• By submitting content to the Platform (including location proposals, descriptions, photographs, 360° panoramic imagery, video references, events, tour information, and other text or media), you grant the Platform the rights described in the 'Submitting Content to the Platform' section above.
• You represent and warrant, for every submission, that: you own or hold the authorised rights to all text, images, panoramic imagery, video, and other media submitted; the content does not infringe any copyright, trademark, privacy, publicity, moral, database, or other right of any third party; every identifiable person depicted has consented to publication; all factual statements are accurate; and the content complies with all applicable laws (including consumer-protection, tourism, food-safety, and advertising rules where relevant).
• You are solely responsible for any consequences of inaccurate, misleading, infringing, unlawful, offensive, or harmful content you submit.
• The Platform may use, display, modify, crop, translate, and promote Submitted Content but assumes no responsibility for its accuracy, legality, safety, or quality.
• Indemnification: you agree to defend, indemnify, and hold harmless Bosnia Guide, its operators, and its affiliates from and against any and all claims, demands, damages, fines, costs, and legal fees (including reasonable attorneys' fees) arising from or related to content you have submitted, your breach of these Terms of Use, or your violation of any third-party right.
• Submitted Content may remain on the Platform indefinitely, including after deactivation of your account, in accordance with the licence granted at submission. See 'Account Deactivation & Data Retention' and 'Content Removal Requests' below.
• The Platform reserves the right to remove any Submitted Content at its sole discretion, without prior notice and without obligation to provide reasons.

Account Deactivation & Data Retention

• Contributors may request deactivation of their account at any time by emailing hello@bosnia.guide from the email address registered to the account.
• Upon deactivation, account sign-in is disabled.
• Account data — such as name, email address, business or organisation name, phone number, and internal account records — may be retained for up to 24 months after the deactivation request, for legitimate purposes including legal claims, accounting and tax records, fraud and abuse prevention, audit logs, and dispute resolution. After this period, account data is deleted, unless a longer retention is required by applicable law.
• Submitted Content (locations, descriptions, photographs, 360° panoramic imagery, video references, events, tour information, and other materials submitted by the contributor) is treated as Platform content under the licence granted at submission, and is retained indefinitely as part of the Platform's content, even after account deactivation.
• A deactivated contributor — or any rights holder — may request removal of specific Submitted Content under the 'Content Removal Requests' section below.

Content Removal Requests

• Contributors may request removal of specific content they have submitted by emailing hello@bosnia.guide.
• Third parties who believe content on the Platform infringes their intellectual property rights, privacy rights, or publicity rights should use the 'Intellectual Property Takedown Procedure' described earlier in these Terms.
• Any person may report content that they believe is inaccurate, misleading, unlawful, offensive, or harmful by emailing hello@bosnia.guide. The Platform will review reported content and act in good faith.
• The Platform will action valid removal requests within a reasonable timeframe, subject to the following:
• Technical and operational feasibility: the Platform will remove content from the live Platform as soon as technically and operationally possible. Some references may persist for a limited period in backups, audit logs, search caches, third-party caches, or downstream copies (including content already downloaded or shared by visitors).
• Legal retention: where applicable law requires the Platform to retain content (for example, as evidence in an investigation, as accounting or tax records, or to comply with a regulatory or court order), the Platform may retain the content for the maximum period permitted, until the legal obligation expires.
• Open disputes: where content is the subject of an open complaint, dispute, or claim, the Platform may retain it until the matter is resolved.
• The Platform reserves the right to refuse a removal request where the request is abusive, vexatious, or appears designed to suppress legitimate information.

Prohibited Use & Anti-Abuse

• Users must not attempt to disrupt, hack, overload, or otherwise misuse the Platform or its infrastructure. Any attempt to gain unauthorised access to the Platform's systems, data, or user accounts is strictly prohibited.
• The Platform does not guarantee uninterrupted or error-free operation. Temporary downtime may occur due to maintenance, updates, or circumstances beyond our control.

Limitation of Liability

• To the fullest extent permitted by applicable law, Bosnia Guide shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or related to the use of, or inability to use, the Platform, its content, or any services referenced therein.
• This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, even if Bosnia Guide has been advised of the possibility of such damages.
• Without limiting the foregoing, Bosnia Guide is not liable for any damage arising from inaccurate, misleading, infringing, unsafe, or unlawful content submitted by contributors or third parties; from any Third-Party Offering presented on the Platform; or from the use of the Platform's content (including AI-generated content) for any purpose.

Changes to Terms

We reserve the right to modify these Terms of Use at any time. Updated versions will be published on the Platform. Continued use of the Platform following any changes constitutes acceptance of the updated terms.

Governing Law

These Terms of Use are governed by the laws of Bosnia and Herzegovina. Any disputes arising from the use of the Platform shall be subject to the jurisdiction of the competent courts in Bosnia and Herzegovina.
